PREAMBLE
The General Terms and Conditions apply to legal operations in connection with products commercialized by Lotta Djossou to its clients on the Internet site.
DEFINITIONS
The following words and expressions shall have the following meanings:
Internet Site: shall designate 's Internet site on which the Products are presented and sold to clients.
Order: designates the sales contract concluded between Lotta Djossou and the client of Lotta Djossou's Internet Site.
Product Index Card: shall designate all existing information pertaining to a product furnished by Lotta Djossou at the time said product is marketed on the Internet site.
Products: shall designate all goods and services sold by on 's Internet site.
Service : shall designate the selling of Products by Lotta Djossou to clients of 's Internet site.
Transaction: refers to all operations, secure processing, authorizations and agreements inherent in the payment of the price of Products ordered by credit card.
ARTICLE 1 - PURPOSE
The purpose of the General Terms contained herein is to define the terms and conditions according to which offers and sells Products to its clients.
These general terms and conditions of sale shall prevail over any other terms and conditions appearing in any other document, except in the event of prior, express and written derogation.
ARTICLE 2 - ACCEPTANCE OF CONDITIONS
The customer acknowledges that he/she has read and understood these terms and conditions of sale at the time the Sales Order is placed, and expressly declares that he/she accepts them unreservedly.
These general terms and conditions of sale govern the contractual relationship between Lotta Djossou and its customer, both parties accepting them without reservation.
ARTICLE 3 - PRODUCTS
The majority of products offered by Lotta Djossou to its customers are immediately available. However, not all products marketed by Lotta Djossou can be sold online.
ARTICLE 4 - ORDERING
The automatic recording systems are considered as proof of the nature, content and date of the Order.
Once the Sales Order has been accepted, Lotta Djossou will send a confirmation e-mail to the client's e-mail address. The sale will only be concluded once the order confirmation has been sent.
Lotta Djossou reserves the right to refuse or cancel any client's Sales Order in the event of the client's insolvency or in the event of non-payment of the Sales Order in question, or in the event of a dispute concerning the payment of a previous Sales Order.
The client is exclusively responsible for any information that he or she provides when making the Sales Order. ARTICLE 5 - DELIVERY
Once the Sales Order has been confirmed, and subject to full payment of the Product(s) ordered by the client, Lotta Djossou will ship the Product(s), under responsibility, to the client or recipients address within workdays.
Where applicable, the customer agrees to pay upon receipt, all taxes, duties, levies and other present and future charges due in respect of the delivery of the said products themselves; Lotta Djossou shall not at any time be held jointly and severally liable in this respect.
Delivery will be made by La Poste Suivi, Colissimo or Mondial Relay at our convenience.
Our delivery rates are quoted when you place your order.
On receipt of the Products ordered, the customer or recipient must check that the goods delivered are in good working order, and must familiarize himself/herself with the conditions of use set out in the instructions supplied.
Should one or more of the Products ordered be missing or damaged, the customer or recipient must make any necessary reservations with the carrier at the time of delivery.
In the event of apparent defects, the customer has the right to return the goods in accordance with the conditions set out in the instructions for use.
For reasons of availability of the Products ordered, an Order may be subject to several successive deliveries to the customer.
Should the client require delivery of Products to two different addresses, 2 separate Sales Orders will need to be placed.
ARTICLE 6 - WITHDRAWAL
The client disposes of days following the receipt of the Products to return said Products to Lotta Djossou for exchange or reimbursement. In this case, the client must return the Products in new and undamaged condition, along with all accessories, user manuals and documentation to the following address:

In the event of exercising the right of withdrawal, Lotta Djossou undertakes to reimburse the sums paid by the customer, free of charge, with the exception of return shipping costs.
Refunds are due within a maximum of 14 days.
ARTICLE 7 - PRICES
The price is expressed in euros.
The price indicated on the Product Sheets does not include shipping costs.
The price indicated in the Order Confirmation is the final price, inclusive of all taxes and including VAT. This price includes the price of the Products, the costs of handling, packaging and storing the Products, transport and commissioning costs.
ARTICLE 8 - PAYMENT
The price invoiced to the client is the price indicated on the Sales Order confirmation sent by Lotta Djossou.
The price of the Products is payable in cash by one of the means of payment proposed on the site on the day of the effective order.
The Sales Order validated by the customer will only be considered effective once the secure bank payment center has given its approval of the transaction.
ARTICLE 9 - APPLICABLE LAW
These terms and conditions of sale are governed by French law.
ARTICLE 10 - LIABILITY
Lotta Djossou shall not be liable for bodily or material damages incurred to any third party resulting from improper functioning or use of the Products.
Lotta Djossou's liability shall in any event be limited to the amount of the order. In the event of difficulties in the application of the present contract, the client and Lotta Djossou reserve the right, prior to any legal action, to seek an amicable solution.
Otherwise, for professional customers, the Commercial Court of the registered office of Lotta Djossou de has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.
ARTICLE 11 - WARRANTY
In all cases, Lotta Djossou shall not be held liable for failure to comply with the laws and regulations in force in the country where the Products are received. Lotta Djossou's liability shall be systematically limited to the value of the Products held liable at the date of sale, and with no possibility for filing claims against the brand name or Product manufacturer.

ARTICLE 12 - LEGAL INFORMATION
The personal information collected for the purposes of distance selling is compulsory, as this information is essential for the processing and dispatch of orders, the preparation of invoices and warranty contracts. Failure to provide this information will result in the Order not being validated.
The customer has the right to access, modify, rectify and delete personal data (article 34 of the French law of January 6, 1978). In addition, Lotta Djossou undertakes not to communicate, whether free of charge or in exchange for payment, the contact details of its customers to a third party.

Lotta Djossou receives, collects and stores all the information you enter on our website (rosedefontaine.fr): Civility, surname, first name, postal delivery address (any additional information relating to delivery), billing address, e-mail address, date of birth, telephone number, information relating to transactions and the follow-up of the commercial relationship (details of products purchased, quantities, amounts, payment methods, any discounts granted).
Lotta Djossou only processes the customer's geolocation via IP address when the customer creates a "customer account". This data is only used to facilitate the creation of the personal account and is neither kept nor reused thereafter.
We collect this information for the following purposes:
- Managing your customer account;
- Providing our customers with ongoing technical assistance and support;
- Managing customer satisfaction and collecting your opinions;
- Combating fraud;
- Subscribing to our newsletter and being regularly informed of our news and offers;
- Organizing competitions;
- Preparing sales statistics.
This personal data is hosted within the European Union.
The data collected is intended solely for use by Lotta Djossou. It will never be passed on to third parties for commercial purposes, nor sold or exchanged, without your express consent.
We keep your data for as long as you remain a customer, but also afterwards, in order to respond to any questions, complaints or legal accounting requirements.
